Cherokee County consolidates the Clerk of Superior Court, Clerk of State Court, and Clerk of Magistrate Court into one office, the Cherokee County Clerk of Courts, based at the Frank C. Mills III Justice Center in Canton. That single office keeps felony criminal cases, civil suits, divorces, real estate and UCC filings, misdemeanors, traffic citations, and small claims and eviction cases.

Cherokee County Probate Court is a separate, independent office for wills, estates, guardianships, and marriage and weapons-carry licenses. Cherokee is also one of the counties on the Tyler-hosted re:SearchGA system for case dockets.

Because the Superior, State, and Magistrate Court divisions share one clerk's office, someone researching a case in Cherokee County generally only needs to know one phone number and one building rather than tracking down separate offices for a felony charge, a traffic ticket, and a small-claims dispute. The main exception is Probate Court, which keeps guardianship, estate, and licensing records under a different judge and a different office in the same Justice Center complex, and Juvenile Court records, which remain confidential regardless of which office administers them.

What is available online

Because Superior, State, and Magistrate Courts share one clerk's office, the case-search tool covers all three court types from a single site, and the county also participates in re:SearchGA. Probate Court keeps its own records separately and is not included in the shared case-search tool.

Which clerk has your record

In Georgia, the clerk who keeps a file depends on which court heard the case. Check the court name on the case notice, citation, or order, then use the office and coverage details above to identify the record holder. Court names and responsibilities differ by state; a county clerk may not keep court case files. For federal cases, see the PACER guide. The full court structure is on the Georgia page.

Sealed and restricted records

Georgia court records are presumed open under Uniform Superior Court Rule 21, which states that "all court records are public and are to be available for public inspection unless public access is limited by law." A judge may seal or restrict access to part of a file only after a hearing, and only when the harm to a person's privacy clearly outweighs the public interest in the record; an order sealing a record can be appealed to the Supreme Court of Georgia under Rule 21.4.

The Georgia guide lists every category of sealed and restricted record, and our guide to expunging or sealing a criminal record explains how to remove one from public view.
